Guidance For Administering A Loved One’s Estate
Being appointed to handle the estate of a family member or friend is both an honor and a burden. You take the responsibilities seriously, but the obligations can be time-consuming and overwhelming.
The law firm of William B. Mills, P.C., offers legal guidance to efficiently fulfill your probate and estate administration duties. Our attorney counsels personal representatives and trustees throughout northern Georgia.
Decades Of Experience In Estate Administration
William Mills has more than 10 years of experience in Georgia estate law. He can walk you through every phase of the estate administration process and help you address any bumps in the road:
- Court appointment as the executor or administrator
- Opening the estate in probate court
- Inventory and appraisal of the assets
- Selling property, if necessary
- Paying debts and taxes of the estate
- Distributions to the heirs per the will (or Georgia intestacy laws)
- Final accounting and reporting
Will The Estate Go Through Probate?
Some estates do not have to go through the probate process, depending on the nature of the assets and other factors. Assets held in a trust, for example, pass directly to the beneficiaries outside of probate. The court can also waive probate if there are no creditor claims and all the heirs are in agreement on dividing the estate. Whether or not the estate is probated, many of the duties are the same for the personal representative. We are here to help you close the estate as quickly and cost-effectively as possible.
What If Conflicts Arise?
Unfortunately, the heirs and beneficiaries are not always in agreement. There may be questions about the will, disputes between family members, or allegations that you (as the representative of the estate) violated your fiduciary duty. Our experienced trial lawyer has counseled and represented personal representatives and trustees in a wide range of scenarios involving estate and trust litigation.
