Will The Estate Go Through Probate?

Some estates do not have to go through the probate process, depending on the nature of the assets and other factors. Assets held in a trust, for example, pass directly to the beneficiaries outside of probate. The court can also waive probate if there are no creditor claims and all the heirs are in agreement on dividing the estate.
